EM Risk Management Helps In City of Binghamton Workers' Compensation Fraud Case

City of Binghamton Employee Paul Moore, 43, formerly of Matthews Street in Binghamton faces a jail term of 1 1/2 to 4 years for his conviction on multiple workers' compensation fraud charges stemming from an injury he sustained in 2004. In a non-jury trial, Mr. Moore was found guilty of willfully and intentionally filing a false accident report with the City of Binghamton for the purpose of obtaining workers' compensation benefits.

"Public servants have an obligation to do what is in the best interests of the people they serve; in this case, the taxpayers of the City of Binghamton. When you betray that trust, you will be caught and you will face prosecution. This arrest and conviction should convince anyone thinking about committing workers' compensation fraud that it is just not worth it in the long run," Workers' Compensation Board Fraud Inspector General John H. Burgher said.

Mr. Moore, who worked at the City of Binghamton Water Department as a water treatment plant operator, alleged on an employee accident report that he sustained a work related injury to his knee in November of 2004. Upon an investigation conducted by the New York State Workers' Compensation Board, it was determined that Moore was actually injured off the job when he was stabbed during a domestic altercation. During a period of November 2004 and January 2005, Mr. Moore was awarded more than $3,200 in benefits for which he was not entitled.

POMCO Group/EM Risk Management, the Binghamton Police Department and the City of Binghamton Office of Corporation Counsel assisted with the investigation. The case was prosecuted in Broome County Court by the Office of the Broome County District Attorney. Mr. Moore is expected to be sentenced in July.
